Technology, Education And Copyright Harmonization Act (TEACH Act)
In 2002, the Copyright Act was extended by the TEACH Act to allow nonprofit educational institutions the ability to transmit content digitally for educational purposes. However, TEACH Act mandated a series of requirements which made it very difficult for Universities to utilize the technology on their own.
We solve that problem with C-Labs:
A content platform for controlling the digital distribution of content which is compliant with the transmission requirements of TEACH Act.
More specifically, TEACH Act dictated a number of restrictions to govern the transmission of copy written works, including:
- The material must be legitimately acquired under copyright law, including Fair Use provisions;
- The transmission of material must implement reasonable technological measures so as to prevent further copying and reproduction;
- Material can only be transmitted to students actually enrolled in the class;
- The transmission of copyrighted works must occur at the direction of, or under the supervision
of an instructor and the transmission can only take place as part of a class session.
C-Labs is compliant with all the above transmission requirements, thus allowing Universities to put video and audio assets online like never before, as they so desire under copyright law including Fair Use provisions.
In addition to being compliant with the transmission requirements of TEACH Act, other control measures have been incorporated systematically into C-Labs.
- C-Labs provides a more secure and efficient replacement for the media lending programs traditionally maintained by most University libraries.
- C-Labs enables educational institutions to decide for themselves what content is appropriate
to distribute through C-Labs for educational purposes; and
- C-Labs calendaring and time sensitive capability allows an instructor to set specific periods for each piece of content in every course.
